You would need permission from the developer to create a flash game with their characters. There have been games with copyrighted characters in with a completely different gameplay such as Kingdom Hearts.Are flash games of known characters legal?
Technically it's copyright infringement, but it's up to the creators to actually enforce the copyright, which most of the time they don't.
